These SMS Terms & Conditions ("SMS Terms") govern the use of text messaging services
provided by Kunes Chrysler Dodge Jeep Ram of Woodstock ("we," "us," or "our") and
constitute a binding agreement between us and the user. We reserve the right to modify,
suspend, or discontinue the SMS program at any time, with or without notice. For the absence
of doubt, by opting in and using this service you agree that SMS/text messages are outside the
scope of the Telephone Consumer Protection Act (“TCPA”) (47 USC 227).
1. Program Description
By opting in, you agree to receive SMS/text messages from Kunes Chrysler Dodge Jeep Ram
of Woodstock. These messages may include, without limitation:

SERVICES, INCLUDING BUT NOT LIMITED TO DAMAGES RESULTING FROM DELAYED,
UNDELIVERED, OR MISDIRECTED MESSAGES. OUR TOTAL LIABILITY TO YOU FOR ANY
CLAIM ARISING UNDER THESE SMS TERMS SHALL NOT EXCEED FIFTY U.S. DOLLARS
(US$50.00).
DISCLAIMER OF WARRANTIES: THE SMS SERVICES ARE PROVIDED "AS IS" AND "AS
AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT
WARRANT THAT THE SMS SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR
FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO

REPRESENTATIONS REGARDING THE ACCURACY OR COMPLETENESS OF ANY
INFORMATION PROVIDED VIA SMS.
3. Opt-Out Instructions
You may opt out at any time by replying:

You may receive a final confirmation message after opting out.
4. Message & Data Rates
Standard message and data rates may apply depending on your mobile carrier and plan. You
are solely responsible for all charges imposed by your carrier in connection with receiving SMS
messages from us.
5. Mobile Data Sharing Policy
Mobile information, including phone numbers and consent status, will not be shared with
unaffiliated third parties for their own independent marketing or promotional purposes,
except as described herein or as required by law.
This includes phone numbers, consent status, and messaging data.
Information may be shared with: (a) service providers and vendors who assist in delivering SMS
messages or related services on our behalf; (b) our affiliates and subsidiaries; (c) any successor
or acquirer in the event of a merger, acquisition, or sale of assets; and (d) governmental
authorities or third parties as required by applicable law, regulation, or legal process.
6. Carrier Disclaimer
Wireless carriers are not liable for delayed or undelivered messages. Kunes Chrysler Dodge
Jeep Ram of Woodstock is likewise not responsible for any delays, failures, or errors in the
transmission of SMS messages caused by your carrier, network conditions, device settings, or
other factors outside our reasonable control.
INDEMNIFICATION: You agree to indemnify, defend, and hold harmless Kunes Chrysler Dodge
Jeep Ram of Woodstockand its officers, directors, employees, agents, and successors from and
against any claims, damages, losses, liabilities, costs, and expenses (including reasonable
attorneys' fees) arising out of or related to: (a) your breach of these SMS Terms; (b) your
misuse of the SMS services; or (c) your violation of any applicable law or third-party rights.
7. Supported Carriers
SMS services may not be available on all carriers or devices.

10. Changes to Terms
We reserve the right to update, modify, or replace these SMS Terms at any time in our sole
discretion. Updates will be posted on this page with a revised or updated effective date. Your
continued receipt of SMS messages following any modification constitutes your acceptance of
the updated SMS Terms. If you do not agree to the updated terms, your sole remedy is to opt
out of the SMS program. To the extent you have used any of our other services and our Master
Service Agreement (“MSA”) or Data Processing Agreement (“DPA”) apply, those agreements
are binding and controlling over these Terms & Conditions.
11. Governing Law; Dispute Resolution. These SMS Terms shall be governed by and construed
in accordance with the laws of the State of Wisconsin, without regard to its conflict of law
principles. Any dispute arising out of or relating to these SMS Terms or the SMS services shall
be resolved by binding individual arbitration administered by the American Arbitration
Association under its Consumer Arbitration Rules. YOU HEREBY WAIVE ANY RIGHT TO
PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. Nothing
herein shall prevent either party from seeking injunctive or other equitable relief in a court of
competent jurisdiction.
